You must be at least 18 years of age to access or use Solm8. By accessing this site, you certify that you are 18 years of age or older.

1. Acceptance of Terms

By accessing or using the Solm8 website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Age Restriction (18+)

Solm8 is strictly for users aged 18 and older. We do not knowingly collect information from or provide services to individuals under the age of 18. If we discover that a user is under 18, their account and data will be immediately deleted.

3. Content Guidelines

While Solm8 allows for open and unrestricted conversation, users must adhere to the following rules:

  • No illegal content or discussions of illegal acts.
  • No non-consensual sexual content (CSAM).
  • No hate speech or harassment.
  • No promotion of self-harm or violence.

Violation of these rules will result in immediate account termination.

4. Data Usage, Recording, and AI Training

To provide you with a realistic and evolving AI companion, we store conversation logs and audio transcripts. By using the Service, you explicitly consent to:

  • Recording: The recording of your audio conversations with the AI.
  • Transcription: The transcription of these recordings into text.
  • Storage: The storage of these logs and recordings to maintain conversation context (memory) and improve AI quality.

Transparency: We are honest about this data collection. It is necessary for the service to function as intended.

5. Incoming Calls & Communications

By using Solm8, you consent to receive incoming telephone calls and text messages from our AI agents. You acknowledge that:

  • These calls are generated by artificial intelligence using synthetic voices.
  • These calls are not from human operators.
  • Standard carrier rates for phone calls and text messages may apply.

6. Your Rights to Your Data

You retain full ownership of your data. You have the right to:

  • Delete your account and all associated data at any time via your dashboard.

Once deleted, your data is permanently removed from our servers and cannot be recovered.

7. Refund Policy

We want you to be satisfied with your AI companion. Our refund policy is designed to be fair while protecting against abuse:

  • 7-Day Money-Back Guarantee: If you are not satisfied with your subscription, you may request a full refund within 7 days of your initial purchase.
  • How to Request: Simply email us at solm8.ai@gmail.com with your account email.
  • Abuse Prevention: To prevent exploitation of this policy, the Money-Back Guarantee applies only to your first subscription. We reserve the right to deny refunds if we detect abusive behavior, such as creating multiple accounts to repeatedly claim refunds.

8. Usage Limits & Subscription Terms

Each subscription plan includes specific usage limits:

  • Free Plan: 30 minutes and 10 calls per month
  • Essentials Plan: 300 minutes and 100 calls per month
  • Soulmate Plan: 1000 minutes and 300 calls per month

Usage limits reset at the start of each billing cycle. Unused minutes do not roll over. We reserve the right to modify plan limits with 30 days notice to active subscribers.

9. NSFW Content Acknowledgment

Solm8 may include adult-oriented conversational content. By using this service, you acknowledge that:

  • The AI may engage in romantic, flirtatious, or sexually suggestive conversations.
  • You are solely responsible for your interactions with the AI.
  • All AI-generated content is fictional and for entertainment purposes only.
  • You will not share or distribute conversations involving other individuals without consent.

10. Disclaimers & Limitation of Liability

AI & Synthetic Voice: Solm8 uses advanced artificial intelligence and synthetic voice technology. The AI's responses are generated automatically and may sometimes be inaccurate, inappropriate, or nonsensical. You should not rely on the AI for factual information.

Not Professional Advice: Solm8 is an AI entertainment service. It is not a substitute for professional medical, psychological, legal, or financial advice. If you are in crisis, please contact a professional emergency service immediately.

No Warranty: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability: TO THE FULLEST EXTENT PERMITTED BY LAW, SOLM8 AND ITS CREATORS, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, RELIANCE ON THE AI'S STATEMENTS, OR THE CONTENT OF CONVERSATIONS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Maximum Liability: In no event shall our total liability exceed the amount you paid for the service in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Solm8 and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising from:

  • Your use or misuse of the service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you submit or share through the service

12. Dispute Resolution & Arbitration

Informal Resolution: Before filing any formal dispute, you agree to contact us at solm8.ai@gmail.com and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration: Any dispute arising from these Terms or your use of the service that cannot be resolved informally shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted in English and the decision shall be final and binding.

Class Action Waiver: YOU AGREE THAT ANY DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE ACTION.

Small Claims Exception: Either party may bring an individual action in small claims court.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the service after such changes constitutes acceptance of the new Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Solm8 regarding the use of the service.
